Ref: Police failure to investigate endemic kidnaps of Pr Robert Kayanja’s aides & sodomy witnesses
I refer to the very successful rescue on Saturday 22-Sept-2012 of the Indian business woman, Nimmi Kumar kidnapped on Friday 21-Sept-2012 by Pakistanis and hid in a Buziga home, carried out by Counter Terrorism Commandos and the Special Investigations Unit, which I believe was carried out with your involvement, publicized by various electronic and print media.
I much commend the swift action, professionalism and sense of duty to protect human life exhibited by the valiant rescue. The rescue proves Uganda Police’s resolve, readiness and ability to deal with terrorists and whoever threatens human life within Uganda’s boundaries. According to Bukedde story of Monday 24 Sept 2012, it is very interesting to note that Police has equipment that was used to track the kidnappers’ exact phone location thereby locating their hideout.
In light of that, I want to draw your attention to human kidnaps that now seem to have become endemic, carried out on Pr Robert Kayanja’s youthful followers some of who have testified against me and / or my co-accused persons in the sodomy saga. The kidnaps are as follows:
a. First it was Chris Muwonge, allegedly ‘kidnapped at gunpoint’ on his way from Rubaga Miracle Centre Cathedral night prayers on the morning of 18 April 2009, held for 5 days and during his captivity, put at gunpoint and promised US $ 120,000 to say on camera that Pr Robert Kayanja sodomized boys. That his kidnappers later dumped him at Kayanja’s home gate in Kawuku, Gaba. On 26 April 2009, Chris Muwonge narrated his ‘ordeal’ before various media at Rubaga Miracle Centre Cathedral. At the same press conference, Pr Robert Kayanja himself implicated Pr Michael Kyazze and his colleagues interested in tarnishing his reputation. (See attachment marked ‘A’) The New Vision April 27 2009 which covered the proceedings under its lead headline: CID PROBES KIDNAP OF KAYANJA’S AIDE: Row deepens among city’s top Pentecostal pastors).
The New Vision also quoted Police Spokeswoman Judith Nabakooba on this kidnap saying, ‘We are taking this very seriously given that it may have security implications. We need to get to the bottom of the matter.’
Red Pepper of 29 April 2009 covered the same kidnap in its lead story, ‘KAYANJA REVEALS HIS HOMO SECRETS,’ (See attachment marked ‘B’) in which Kayanja directly implicates us.
Sadly this ‘kidnap’ has never been demystified despite file CRB 2391/2009 opened at Old Kampala.
To prove that Pr Robert Kayanja knew and still knows the kidnappers and should have given the Police very good leads, his lawyers, Katende Ssempeebwa & Co Advocates wrote to each of us as accused save Deborah Anita Kyomuhendo and David Mukalazi, accusing us of kidnapping with intent to murder, confine and other heinous crimes. (See copy of his letter to me attached, marked ‘C’). Despite such threats, none of us as accused persons has ever made any statement or been bothered by Police or any other investigating agency in respect of any aides’ kidnaps.
b. Next to be ‘kidnapped’ was Herbert Tumukunde, allegedly kidnapped at 07.45pm on Monday 11 May 2009 by ‘four masked men’ within the Miracle Center Cathedral premises, dragged into a waiting car, Toyota Mark II which immediately drove off, and he was tortured; and that after about two hours, he was driven back to Rubaga Miracle Center and dumped in a ‘secluded place’ where they proposed to slaughter him and set him on fire. In her lead story (see attachment marked D), ‘KAYANJA SODOMY SAGA TAKES NEW TWIST,’ The Red Pepper of Wednesday 13 May 2009 quotes him say, ‘They tried to strangle me as they beat me up after I refused to promise them that I would pin my pastor on sodomy acts. They drenched my entire body in paraffin as they mercilessly kicked my balls and threatened to slice my throat. However, I was saved by two people who emerged from behind the church prompting my captors to take off.’
Surprising about this ‘KIDNAP’ is that Tumukunde was untied by Police in the deep of the night in the presence of Pr Kayanja, the media, medics and ambulance from International Hospital Kampala. What a coincidence! Police sniffer dogs immediately engaged to trail the kidnappers got nothing.
Just like in the Chris Muwonge ‘kidnap’, Red Pepper said Police publicist Judith Nabakooba confirmed the ‘kidnap,’ adding, ‘It is unfortunate that we (Police) have to be called in on a regular basis over similar issues but our work is to investigate and provide security, we promise to do exactly that.’ Though she declined to divulge details, she implied many kidnaps.
This ‘kidnap’ too remains uninvestigated though I and my co-accused were very clearly implicated; and life continues as if it never happened. Even in court, Tumukunde declined to talk about it.
c. The same Red Pepper story, ‘KAYANJA SODOMY SAGA TAKES NEW TWIST,’ (attachment D) also reveals an alleged attempted kidnap: that on Sunday 10 May 2009, two young men were arrested from Rubaga Miracle Center premises when attempting to kidnap a young man from there. That the two (names not disclosed) were allegedly being held at Old Kampala Police Station where an attempted kidnap case had been opened. Sadly, like the two kidnaps cited, this was dumped into the Compost of History as if it never happened.
d. Next were the startling alleged ‘kidnaps’ of John Mutumba and Robson Matovu of July 8 2012 which were only reported to Police on 30 July 2012 allegedly after their videos retracting what they had stated in court hearings of Buganda Road Court criminal case 1063 of 2010 (Uganda V Pr Moses Solomon Male, Pr Dr Martin Sempa, Pr Michael David Kyazze, Pr Robert Kaira, Deborah Kyomuhendo and David Mukalazi) had featured on You Tube, and well after I had reported and even written to you to investigate the contents of their videos.
After reporting the development to Kampala Metropolitan CID and my letter dated and delivered to you 28th July 2012; The New Vision of 1 Aug 2012 and The Observer, Aug 1 2012 (See attachment E) ran stories of kidnaps of John Mutumba and Robson Matovu, whose video was also cited posted on You Tube.
I managed to get copy of the video of their alleged kidnap story posted on You Tube and have enclosed it with its transcribed version (attachment F) and their first videos for your scrutiny.
In the video retracting the videos whose copy I sent to you and have sent again, these are eminent:
a. That contrary to a sense of freedom to speak and passionate expression of emotions in their first videos, they are now confined, visibly distressed and fearful, fail to flow and fidget with what to say.
b. That contrary to what they say on the videos I received on 25th July 2012 whose copies I delivered to you as per my letter of 28/July/2012, these witnesses now allege that they were kidnapped, put at gunpoint and ordered to read what had been written on paper as the kidnappers (presumably from the accused camp – me and my co-accused) recorded them on camera to produce the videos.
Whereas Mutumba alleges to have been kidnapped at night on his way from work at Miracle Centre Cathedral, Rubaga, where he allegedly works as a cameraman; Matovu alleges to have been called and deceived that Mutumba had got an accident, then kidnapped on his way to get to him. Their captors were armed with among others machineguns / AK 47. Both had allegedly been sedated.
c. That some few months earlier, there was another alleged kidnap of another of Pr Robert Kayanja’s many aides known as Ezekiel Wambuzi, a technician of Rubaga Miracle Centre Cathedral who was allegedly captured, hit and seriously injured.
d. After viewing and reviewing the video, bearing in mind that it is not in dispute that the only people in court charged with tarnishing Pr Robert Kayanja’s reputation and trade are the undersigned and my co-accused: Pr Dr Martin Sempa, Pr Michael David Kyazze, Pr Bob Kaira, Deborah Anita Kyomuhendo and David Mukalazi; I realized that their allegations on this video not only give ‘very clear leads’ for anyone serious about investigating and bursting the kidnapping racket that I and my co-accused are masterminds of their alleged ‘kidnaps’ if they were ever kidnapped, but give the motive: ‘despair to kill evidence presented against us.’
e. The video portrays us as organized criminals in possession of guns: AK 47 / Sub-machineguns with capacity to kidnap or cause kidnaps of Pr Kayanja’s aides and witnesses which any sensible, dutiful and professional Police officer serious about bursting criminal rings must be keenly interested in investigating rather than merely record statements from alleged kidnap victims and shelve the files.
f. That Pr Robert Kayanja’s aides and former accusers’ lives are in real danger because of kidnappers who with all impunity trail and kidnap them at gunpoint and at will and put them on camera to allege that he indulges in sodomy, without anyone seriously bothered; and such may lead to loss of life.
Sir, very surprising and disturbing is that since the kidnap video was recorded, posted on You Tube and statements made to Police on file GEF 198/2012, then their story featured in national media, there seems to have been not even the least interest for Police CID to investigate such glaring allegations when in the Nimmi Kumar kidnap by Pakistanis, Police action was so prompt and professional, leading to her rescue.
More disturbing is that since the kidnaps started way back in 2009, what the public has been told by Police publicist Judith Nabakooba is that the Police is seriously investigating the matter. I am not aware of any statements recorded from key suspects mentioned in respect of each kidnap; and ‘kidnaps’ have continued with impunity; each time merely confirmed by Police even where leads are very clear and suspects at large! In some cases, Police seems to have even been unaware of the kidnaps altogether and kept silent about them.
Sir, these ‘kidnaps’ raise lots of ethical pertinent questions which you, as head of the Uganda Police Force need to clearly answer so that hearts and minds of right thinking Ugandans can get peace; some as hereunder:
a. Who really masterminds the kidnaps of Pr Robert Kayanja’s aides and sodomy witnesses: Chris Muwonge, Herbert Tumukunde, John Mutumba, Robson Matovu, Ezekiel Wambuzi and others?
b. Why is it that despite all leads pointing to us: me Pr Moses Solomon Male and my co-accused in Buganda Road Criminal case 1063 of 2010: Pr Dr Martin Sempa, Pr Michael David Kyazze, Pr Robert Kaira, Deborah Anita Kyomuhendo, David Mukalazi and people close to us in the awareness campaign against homosexuality and sexual abuses in Uganda, none of us has ever recorded even a single statement as a suspect in respect of any of the kidnaps?
c. Why is Police CID not interested in investigating kidnaps where crucial leads to kidnappers exist?
d. Why wasn’t Chris Muwonge’s kidnap known till the press conference of April 26 2009 called by Pr Robert Kayanja at his Rubaga Miracle Mentre Cathedral?
e. Why did the Police have to wait for the media and ambulance before untying Tumukunde who had allegedly been kidnapped and drenched in paraffin? Was the emergency for a public show?
f. How could Robson Matovu be kidnapped yet it is no secret that he was under the Police Witness Protection which you personally okayed during our meeting with you on Friday May 22 2009?
g. How could have Mutumba and Matovu, kidnapped on a single day, 8/7/ 2012, put at gun point, recorded on Camera when ‘reading’ retractions of what they had stated in Buganda Road Court, released on 9/7/2012, and returned home or to Police Witness Protection, kept quiet; not even tell their Police guards or Pr Kayanja and his team about it, and had to wait till it featured on You Tube then they reported at the Special Investigations Unit on 30 July 2012 that they had been kidnapped three weeks earlier, which opened GEF and to the best of my knowledge, shelved it?
h. Why didn’t Robson Matovu’s bodyguards in the Police Witness Protection report the disappearance of the person put under their charge for protection, or Channel 44 report Mutumba’s disappearance?
i. Is Police aware that the kidnap allegations are just faked up, intended to portray Pr Kayanja as endangered, the very reason it is not interested in investigating them? If faked up, why not charge all kidnap claimants for giving Police false information intended to portray us as kidnappers?
j. Do individual Police officers have discretion to choose what to or not to investigate of crimes reported as it seems to be with the kidnaps? If they don’t have it, why not compel them?
k. Could Police Investigators know who is really kidnapping Kayanja’s aides and sodomy witnesses but cannot simply dare touch that / those person/s?
l. Could Police Investigators be aware that the kidnaps are Pr Kayanja’s inside jobs intended to manipulate the public that he is being framed and therefore see no need of investigating them; or his generosity like the 2009 renovation of Old Kampala Police toilets have blinded them on the inside job kidnaps? If inside jobs, why not charge masterminds and perpetrators of such heinous crimes?
m. Could there be involvement of some of your trusted senior Police officers in the kidnaps blocking would be investigations or there is the notorious ‘ORDER FROM ABOVE’ not to investigate?
n. Why does Police act fast in case of Nimmi Kumar, the Indian business woman kidnapped in Uganda, but bothers not to investigate kidnaps of black Ugandans? Don’t the lives of ‘kidnap victims’ Chris Muwonge, Herbert Tumukunde, John Mutumba, Robson Matovu, Ezekiel Wambuzi and others mean anything to our valiant and apparently highly trained and professional Police force?
o. If true that I and my co-accused are the real masterminds of the alleged kidnaps; why aren’t we ever questioned? How can we prove to be too powerful to be touched when we ‘commit felonies,’ yet on mere tramped up conspiracy misdemeanors, we are arrested and tossed in courts like no bodies?
Sir, without a satisfactory explanation, failure by Police to thoroughly investigate the kidnaps and bring the armed perpetrators and mafia to justice when for over three years, Police CID brass led by the CID Directors and the current Assistant IGP Grace Akullo has been vigorously pursuing our conviction on faked up conspiracy charges, and SIU could investigate and recover an assortment of military ware from Kabaziguruka’s compound which has a perimeter wall (See New Vision 24/9/2012 story: Kabaziguruka’s home searched, two held) leads any right thinking Ugandan to believe the following:
Ø Police Investigators know the kidnappers of Pr Robert Kayanja’s aides and sodomy witnesses but cannot dare touch them.
Ø Police Investigators are aware that the kidnaps are Pr Kayanja’s inside jobs and hoaxes intended to manipulate the public to believe that he is really being framed on sodomy and therefore part of the endangered human species, but can’t dare investigate them because of his generosity to the Police and / or higher connections in corridors of power.
Ø Police has conspired with Pr Robert Kayanja to hoodwink the public that he has rivals, and has gone ahead to collude with him to stage the alleged kidnaps for the sake of clearing him of sodomy.
Ø Powerful criminals are bedfellows with some of your Police officers the very reason why heinous crimes like the ‘kidnaps’ at hand are never investigated: Police protects them with impunity.
Ø Police acts fast in cases of foreigners in trouble in Uganda than Ugandans in trouble in own country.
Sir, if I am wrong or mistaken, I beg to be corrected. The pain I have may overwhelm my sense of reason. And I hope this time you will respond and not keep silent like in other instances where I have written to you.
Finally and with all due respect to you, I request that in light of the above, you personally undertake to:
Ø Investigate contents of John Mutumba and Robson Matovu videos retracting their court testimonies.
Ø Thoroughly investigate and demystify all the Pr Kayanja aides and sodomy witness kidnaps cited.
Ø Cause all culprits involved, even if it is us as implicated by Kayanja and victims, to be prosecuted.
Ø If kidnaps have been faked, ensure that all those involved in fooling Ugandans are prosecuted.
Please treat my appeal with the urgency and importance it deserves because all kidnaps have involved men with military ware: machine guns / AK 47, etc that if not stopped may lead to loss of life. Let not the fight for equality, justice and human dignity paid for by the blood of gallant NRA fighters in the Luwero jungles, led by H.E. Yoweri Kaguta Museveni and to which you greatly physically contributed be in vain.
